First Environmental Court Litigation Launching On Environmental Disaster in Ararat Valley

On 5 February, at 12:00,  Public Environmental Court will examine the case on violating the balance groundwater resources in Ararat artesian basin at Ibis Hotel (5/1 Northern Avenue, 2nd floor, Karin Hall). The Public Environmental Court is organized by 'EcoLur' Informational NGO. The purpose of administering public justice is recognizing the activities of governmental bodies as a result of the assessment of the disastrous environmental state due to the decisions of the governmental bodies so far as an environmental crime, to give legal substantiations and to be held liable those who are guilty.

During the litigation, the case on violating the balance groundwater resources in Ararat artesian basin will be held. The balance of water resources in Ararat Valley has been violated in recent 10-15 years as a result of ruthless, unregulated and illegal use of groundwater resources in Ararat artesian water basin. As a result of the decisions reached by competent bodies in water resources use and preservation and permits they issued, the surface of groundwater area with positive pressure in the Ararat artesian basin has reduced by three times –  from 32,760 ha in 1983 to 10,706 ha in 2013. Thirty-one communities have partially or completely got deprived of irrigation and drinking water received from deep gushing wells. The extent of mineralization of water resources has increased. Around 400,000 villagers have faced the fact of losing the opportunity to deal with agriculture. In order to meet the reducing water demand in Ararat Valley, additional water outlets have already led to the deterioration of the state of Lake Sevan.

Dozens of articles of RA water code, RA Law 'On Main Provisions of National Water Policy', RA Law 'On National Water Program' have been violated. Nevertheless, no one has born responsibility. The people of the Republic of Armenia have been recognized as victims in this situation. Competent governmental bodies in charge are National Water Council Adjunct to RA Prime Minister, RA Nature Protection Ministry, RA Agriculture Ministry, RA Water Committee, Ararat Regional Municipality, and Armavir Municipality. Armenian Environmental Front member Levon Galstyan has filed an application to Public Environmental Court.

The court members are environmental lawyer Nazeli Vardanyan, ethnographer and publicist Hranush Kharatyan, human rights defender Zaruhi Hovhannisyan, lawyer and expert in environmental law Heghine Grigoryan, and President of 'EcoLur' Informational NGO Inga Zarafyan.
