Public Environmental Court Ruled Recognized Elimination of Dalma Gardens in Yerevan as Environmental Crime

Public Environmental Court ruled to recognize the offences committed in Dalma Gardens having led to environmental disturbance in Yerevan as a crime against nature, humanity and state.

On February 7, 2020, ny the initiative of “EcoLur” Informational NGO, “Center for Public Awareness and Monitoring” NGO and “Dalma-Sona” Foundation, the Public Environmental Court heard the case of "Continuous Destruction of Dalma Gardens", according to the application by Marie Chakryan, President of “Center for Public Awareness and Monitoring” NGO.

The judges in the case were Environmental Lawyer Nazeli Vardanyan, publicist, ethnographer Hranush Kharatyan, President of “EcoLur” Informational NGO Inga Zarafyan and journalist Tehmine Yenokyan.

“1. Offences in Dalma gardens, which have undermined ecological security in Yerevan, have led to the destruction of ecosystems and historical and cultural sites, contributed to the deterioration of socio-economic status, violated the rights of Yerevan residents, as well as the rights of Dalma land users, which resulted in causing irrecoverable environmental, cultural and economic damage of particularly large extent, are recognized as a crime against nature, human beings and the state.

2. To hold the Ministries of Justice, Environment, Education, Science, Culture and Sport, Emergency Situations, Ministry of Territorial Administration and Infrastructure, State Committee of Real Estate Cadastre and Yerevan Municipality liable for the situation.”
