Kapan-based 'Regional Monitoring Institute' NGO Addressed A Letter to EBRD Top Managers EcoLur Kapan-based 'Regional Monitoring Institute' NGO has addressed a letter to the European Bank for Reconstruction and Development (EBRD) top managers. Reminder: the EBRD together with the Asian Development Bank is funding Kapan water supply improvement system project. The letter says:

Dear Sir/Madam

The implementation of improvement activities of the water supply system for the city of Kapan was initiated about two years ago. In October 2015 it will be two years that two major investment programs have been implemented in Kapan which come to their completion. One of the programs implemented by “Armenian Water and Sewerage Company” CJSC is funded by the Asian Development Bank.  “Armenian Water and Sewerage Company” CJSC and the Municipality of Kapan assure that in 2015 the residents of Kapan will have all day long and high quality water supply system. After the launch of the aforementioned programs a great number of issues arose (destroyed streets, inconveniences for the road traffic participants, frequent disorders in water supply, water of uncertain quality, etc) the complete answers of which we can’t acquire up to day.  In the course of the program implementation I have submitted requests to the Municipality of Kapan and to “Armenian Water and Sewerage Company” CJSC. The Municipality of Kapan provided certain information, whereas “Armenian Water and Sewerage Company” CJSC didn’t present any information at all. Regardless of the fact that the Municipality of Kapan has provided certain information and doesn’t refuse the cooperation, we haven’t still been provided with the copy of the agreement signed between the Municipality of Kapan and “Armenian Water and Sewerage Company” CJSC dated 11.04.2014. We can’t still find out which organization conducts the testing of drinking water quality supplied to the city of Kapan by “Armenian Water and Sewerage Company” CJSC; the Municipality of Kapan doesn’t provide the copy of the latest conclusion on the drinking water quality presented by “Armenian Water and Sewerage Company” CJSC, neither does it provide any information on the amount charged for cleaning services of drinking water included in the water supply tariff, nor on the amount charged for the cleaning of waste water included in the tariff for water drainage system.

We would also like to draw your attention to the fact that neither the Municipality of Kapan, nor “Armenian Water and Sewerage Company” CJSC seem concerned about the geological survey work being carried out near the water receiver supplied to the city of Kapan, though there are no guarantees that mining activities won’t be carried out there in the future as well.

Hence, the essential information regarding the abovementioned programs is unavailable: “Armenian Water and Sewerage Company” CJSC and the Municipality of Kapan merely avoid providing complete and comprehensive information. The effectiveness of the implemented programs is exposed to danger due to existing non-transparent tactics.

Still on 15.10.2010 a group of residents from Kapan filed a claim to the Court of First Instance of Syunik region against “Armenian Water and Sewerage Company” CJSC on proper implementation of their contractual obligations and on elimination of the threat caused to the environment, the health and welfare of the people. Under the decision dated 24.03.2011 the court satisfied the claim (civil claim N SD/0799/02/10). The defendant appealed against the court acts, however the appeal was upheld. On 11.04.2012 the aforementioned decision entered into force. The defendant doesn’t enact the court decision: the waste water falls into the river Voghdji without being cleaned in the city of Kapan, thus threatening the environment and people’s health. I received the writ of execution which was later submitted to the Judicial Acts Compulsory Enforcement Service for enactment on 24.10.2012. The enforcement proceeding N 01/02-5933/12 was initiated on 01.11.2012. The Judicial Acts Compulsory Enforcement Service displayed unjustified inaction not implementing the court decision. The Prosecutor’s Office doesn’t take relevant actions as provided by law.
