Police Requalified NGOs' Report from False Reporting to Libel

Chief Department on Combating Organized Crime of RA Police as represented by Captain, Lead Investigator H. Mkrtchyan rejected the initiation of a criminal case based on the report filed by “EcoLur” Informational NGO President Inga Zarafyan and “EcoRight” NGO Project Manager Arthur Grigoryan. The decision says, “Inga Zarafyan and Arthur Grigoryan have filed a report to the Head of Chief Department on Combating Organized Crime of RA Police based on the fact that unknown people posted a video on Facebook page called “Beyond Brackets” on 25 November 2016, where they were accused of extortion of huge amounts of money.

In their explanations given Inga Zarafyan and Arthur Grigoryan denied any extortion by them voiced in the video and asked for the support of the police to identify and detect the creators of the video. The investigation showed that the concerned video was posted on Facebook social network page entitled “Beyond Brackets”, which doesn’t have any identification data (e-mail, telephone number, business address etc.), which would enable to identify the use and to make relevant clarifications. Besides, no organization called “Beyond Brackets” was recorded in the electronic system of State Registry of Legal Entities of RA MoJ. At the same time, the activity described by Inga Zarafyan and Arthur Grigoryan doesn’t contain features of the crime laid down in Article 333 of RA Criminal Code (False Crime Reporting), while it has been substantiated this activity comprises features of libel, which shall be solved in civil domain taking into consideration that the amendments made to RA Criminal Case in 2010 decriminalized Article 136 (Libel), which goes to Article 1087.1 of RA Civil Code.”
