Vernashen Community Fight against Gladzor Gold Polymetallic Mining Reached Court

Vernashen community's struggle against Gladzor gold-polymetallic mining in Vayots Dzor Region reached the court. The community has filed a complaint to RA Appeal Court demanding to annul and to have a new trial of the judgment delivered by RA Administrative Court, which found in favour of 'Vayq Metal' LLC and annulled the rejection of RA Ministry for Energy Infrastructures and Natural Resources on Gladzor mining. The project – affected community, Vernashen, want to be a third party in the court litigation and to protect its rights through appealing to RA Appeal Court. 'Court neglected the fact that the mine will be developed in a community-owned land area and there are decisions of two communities on not permitting mining in their land areas and tried a case, where the rights of Vernashen community have been covered without involving the Municipality of the given community as a third party, a judgment was delivered factually permitting mining in the community area, thus violating the rights and legal interests of the community. … Thus, the Administrative Court violated provisions lad down in the Convention on the Protection of Human Rights and Fundamental Freedoms by not involving Vernashen community as a third party, which owns the mining area and the judgment delivered is violating the rights of this community,' the complaint particularly says.
