On 25 September RA Appeal Court on Civil Matters rejected Gladzor Community Head Armen Movsisyan's appeal against the ruling reached by Court of General Jurisdiction of Ararat and Vayots Dzor Regions.
The court decided to find for 'Vayq Metal' LLC and not to hinder carrying out geoprospecting works by 'Vayq Metal' LLC in the area of Gladzor Community based on the contract signed by the company and RA Ministry for Energy Infrastructures and Natural Resources.
The Appeal Court didn't consider the grounds of the plaintiff's appeal as substantiated and didn't consider that the Court of General Jurisdiction of Ararat and Vayots Dzor Regions had a judicial error affecting the outcome of the court case.
Gladzor Community Head appeal complaint says, 'With its judicial act, the court forced the community head to perform illegal actions, as the law clearly says that the community head can sign a soil management agreement in the field of soil management and preservation with people entitled to soil management only upon the decision of the Aldermen's Council. The court forced the respondent not to hinder the performance of the obligations prescribed in the soil management agreement № P-005 signed between 'Vayq Metal' LLC and RA Ministry for Energy Infrastructures and Natural Resources on 14.09.2016, when the plaintiff had no permitting document, when its machinery entered the administrative area of Gladzor community and performed certain activities.' In her interview with EcoLur Gladzor Community Head's Barrister Nazeli Vardanyan said they are going to appeal at Cassation Court.
