On 30 May RA Administrative Court found in favour of 'Vayq Metal' LLC against RA Ministry for Energy Infrastructures and Natural Resources and annuled the Ministry's rejection of soil management permit for Gladzor polymetallic mining project. In regard to RA Ministry for Energy Infrastructures and Natural Resources's rejection, '...the court finds that the disputed decision hs been adopted at the same tome violating the plaintiff's rights, and this fact is a legal ground to annul the decision in line with Article 63 of RA Law 'On Administration and Administrative Proceedings'.' In regard to the negative opinion issued to Gladzor polymetallic mining by RA Nature Protection Ministry, the court said, 'Under such conditions the court doesn't find it necessary to refer to the factual non-implementation of expert assessment by RA Nature Protection Ministry and the negative opinion of the environmental impact assessment, as evidence in the ground of the disputed decision claiming a proper expert assessment can be carried out based on the application of the company, which will be assessed by the administrative body in the frames of the new proceedings.'
With this substantiation, Judge Karen Avetisyan reached this ruling, 'Guided by Article 60, Article 114 (6), Articles 124-127 and Article 130 of RA Administrative Procedure, the court found in favour of 'Vayq Metal' LLC and annuled rejection no. 05/29.2/6994-16 dated on 22 December 2016 issued by RA Ministry for Energy Infrastructures and Natural Resources.
