In 2019, RA Government approved the decision of RA Government "On approving the program of activities of the Government of the Republic of Armenia for 2019-2023" N 650 - L, according to its Annex 1, RA Ministry of Emergency Situations has a ten-day period to present a list of particularly dangerous production facilities and the corresponding decision till February 1.
Draft decision of RA Government "On approving the program of activities of the Government of the Republic of Armenia for 2019-2023" N 650 - L is not available on the official website www.e-draft.am. Meanwhile, one of the main goals of this decision, according to the substantiation of the above-mentioned legal act, is to provide compensation for the damages suffered by the citizens affected by the man-made and production accidents of particularly dangerous objects operating in the republic. The other goals are:
• Introduction of compulsory insurance institute for the purpose of mitigating the impacts,
• Tightening the standards of technical safety of these facilities and tightening the responsibility of the experts in the process, targeting the technical, fire and explosiveness factors of the object.
• Carrying out state-level expertise on them.
It should be noted that the requirement of the insurance institute was initially laid down in RA Law on Ensuring State Regulation of Technical Safety.
Still in 2017, RA Ministry of Emergency Situations put into circulation on e-draft.am website the draft decision of the Government of the Republic of Armenia “On approving the list of particularly dangerous production facilities subject to compulsory insurance”, which is listed as being in the process of being amended and supplemented. This draft law names 39 particularly dangerous production facilities subject to compulsory insurance, including 8 mining facilities.
Metal mining in Armenia is developing intensively, no new technologies are being introduced, as a result of continuous use of cheap mineral extraction technologies, a large number of rare and scattered elements are not extracted and the whole cycle of mineral development is not provided, which creates serious challenges for the Republic of Armenia. The relevant bodies ignore the claims for damages. The question arises in this case, what prevents the Government from addressing this issue and solving it.
