State Incurred Essential Damage Due to Improper Preservation of Forest Area in Erebuni Forestry Enterprise

President of “EcoLur” NGO Inga Zarafyan filed a report to RA Chief Prosecutor’s office for the purpose of checking the expediency of the use of 59 million AMD allotted for reforestation in Erebuni forestry enterprise and the lawfulness of the allocation of 2.42 ha of forest areas for the construction of a new landfill site in Nubarashen by submitting the verdict of the “Public Environmental Court” public initiative (minutes). The report and relevant documents were on 29.04.2019 to Erebuni Division of RA Police through Prosecutor’s Office of Erebuni and Nubarashen Administrative Neghborhoods for the preparation of material in a criminal procedure.

The preparation of the materials showed that in line with the governmental resolution N 550-N dated on 5 May 2011 59 million AMD was transferred from the state reserve fund to RA Reforestation and Development Foundation for the reforestation of 51 ha in Erebuni Forestry Enterprise, laying an irrigation network and fencing.

For the implementation of these works, RA Reforestation and Development Foundation and “ArmForest” SNCO signed a subcontracting agreement, nevertheless, later the proper preservation of this forest area was not carried out due to the abuse of the work-related obligations of the officials at “ArmForest” SNCO and, as a result, the state incurred essential damage.

Taking into consideration that the prepared materials contain data having the properties of the crime of abusing official powers by competent officials at “ArmForest” SNCO, in this regard a criminal case was instigated based on Article 308 (1) of RA Criminal Code at Erebuni Division of Yerevan City Department of RA Police and the case has been sent to the investigative department of Erebuni and Nubarashen Administrative Neighborhoods of RA Criminal Investigative Committee for the preliminary investigation. The preliminary investigation has already been launched.
