RA Prosecutor's Office Response In Regard To Verdict of Public Environmental Court

The RA Prosecutor's Office considers the issues raised in the verdict of the Public Environmental Court on the issue of Dalma Gardens to be non-factual.

The letter No. 5/5 / 14609-2020 dated on May 26, 2020 by Head of the Department of State Interests Protection of the RA Prosecutor's Office V. Rafaelyan addressed to Ruzanna Ghazaryan, President of Dalma-Sona Educational-Cultural, Social-Environmental Foundation, says:

“Regarding the verdict of Public Environmental Court BHD 01/20, I would like to inform that still on December 16, 2019, a criminal case was initiated on the grounds of damage to monuments in the area called "Dalma Gardens" in the city of Yerevan by the construction company, where it was found out that the wine cellar in Dalma Park was destroyed by the company in the course of the construction works.”

In addition, the Prosecutor of Yerevan City submitted petitions to the Ministry of Education, Science, Culture and Sports of the Republic of Armenia and Yerevan Municipality regarding the need to review the regulations in the field of discovery, registration and preservation of objects of historical and cultural value so as to prevent possible damage to such facilities in the future.

I would also like to inform you that the other issues raised in the verdict are of a general nature, which do not contain factual data on the prepared or already committed crime, which contains features of a crime, therefore, it cannot be discussed by the procedure envisaged by RA Criminal Procedure Code.

The verdict of the Public Environmental Court summarizes data since 2001, when the "false legal" process of transferring the lands of Dalma Gardens to various legal entities and individuals with the support of RA Government and Yerevan Municipality began. Evidence of Dalma Gardens' status of historical and cultural heritage and violation of land users' rights, legislative violations, expert conclusions and opinions voiced during the public trial are presented. Violations detected by the Public Environmental Court and the actions expected from RA Prosecutor's Office are mentioned in the verdict.
